Comedian Tracy Morgan was involved in a horrible accident with a Walmart Truck and has recently filed a lawsuit against Walmart citing negligence on their part. The accident occurred on the New Jersey Turnpike left several people severely injured and killed comedian James McNair, commonly known as Jimmy Mack.
The lawsuit was filed in the United States District Court in New Jersey on behalf of Morgan, his assistant Jeffrey Millea and comedian Ardley Fuqua Jr. It claims that the company exhibited negligence in the ownership and operation of its truck that was a “substantial contributing factor” to the devastating accident. The driver of the truck, Kevin Roper was charged with vehicular homicide and claimed that he had not slept in more than 24 hours.
Major details have emerged that favor Morgan’s case. In the lawsuit, Morgan’s lawyers claim that Walmart allowed Roper to drive 700 miles from his home to a Walmart distribution center to begin his drive. That drive alone would have taken him more than 11 hours, meaning that driver would have already been driving for an extended amount of time prior to beginning the route that would leave Morgan injured and Jimmy Mack dead. The suit contends that Walmart could have asked Roper to report a center closer to his home. The lawsuit seeks a jury trial and punitive and compensatory damages on behalf of those who were injured or suffered because of the accident. Punitive damages are sought to punish Walmart because it alleges that it was their policy to have this driver report to this place of business so far from his home and that this contributed to the accident.
