The President of LC General Engineering & Construction Company and 2 employees have been arrested due to their connection with the death of a worker crushed by a steamroller in 2016. Michael Sommer, President, Project Manager Manuel Silao and Construction Foremen Ramiro Pena-Pena allegedly allowed an unqualified and untrained worker to operate a heavy steamroller that fatally crushed another employee on a work site. The accident happened at the intersection of Vicente Street and 18th Ave. in San Francisco in January 2016.
The President of the company and the other 2 employees were arrested and each was charged with a single felony count of involuntary manslaughter and three felony violations of the labor code, officials said. The District Attorney of San Francisco George Gascon was quoted as saying “When businesses ignore regulations designed to create safe workplaces, they put their employees and the community at risk,” and “The stakes are high, and the volume of construction under way in San Francisco requires these companies to take the precautions necessary to mitigate the risk of injury.” OSHA records show LC General Construction was cited for six health and safety violations, four of which were serious, in the fatal 2016 incident. OSHA is the agency responsible for investigating workplace safety violations.
There are companies willing to compromise safety in their quest for profit and this quest can lead to consequences like this. In this case a man died and a family is left without a father and a husband. Had OSHA not completed their investigation how many more people could have been at risk and met a similar fate? At times like this people need an advocate willing to step in, perform the investigation, ask the difficult question’s and get reasonable compensation so the family can move on and rebuild their lives.
