We recently wrote a blog about a 2006 case where a Toyota Camry was involved in an accident that killed 3 people and the driver alleged at the time that there was a defect in the car that was the cause. At that time the driver, Koua Fong was arrested for Criminal Vehicular Homicide and subsequently spent over 2 ½ years in prison before being released. The reason for his release was the sheer number of other drivers reporting the same issue with similar results.
The jury heard the evidence and after deliberation a verdict was returned against Toyota and they must pay nearly $11 Million dollars. They ruled that the company was 60 percent to blame for the accident and the system in Minnesota requires that the company pay 100% of the verdict. At this time it is unclear if Toyota will appeal the decision.
This case is a stellar example of a hard-nosed injury advocate representing their client and actually going to court with the evidence and winning against one of the largest corporations in the world. Keep in mind that Mr. Fong spent 2 ½ of his life in prison after being accused of a crime that he clearly did not commit and was finally able to prevail over the company that was shown to actually be the cause of the deaths and his incarceration. While Mr. Fong will never get those years of his life back it is comforting to know that both the criminal justice system works as does the civil justice system. Mr. Fong got his day in court and he prevailed.
