After 2 verdicts awarded to cancer victims who used Monsanto’s herbicide, parent company Bayer AG agreed to pay in excess of $10 Billion to settle as many as 125,000 lawsuits by ailing U.S. users of their product. The settlement will also establish a scientific panel to determine if Roundup weed killer and its active ingredient glyphosate cause cancer.
Monsanto and Bayer maintain that settling these cases when viewed against the significant financial risks of multiyear litigation and related impacts to their reputation and their business make sense. Bayer acquired Monsanto for $63 Billion in 2018 and they hope to return the conversation to one about safety and science in a regulatory arena.
Attorney Brent Wisner, a lawyer for the victims called the settlement a huge first step in correcting 40 years of harm. One of Wisner’s clients was a groundskeeper and pest control manager for the Benicia Unified School District from 2012 to 2016 and his case was the first in the nation to go to trial. He sprayed a form of Roundup called Ranger Pro 2- to 30 times a year for 2 to 3 hours at a time and had been diagnosed with terminal non-Hodgkin’s lymphoma.
A jury in 2018 found that Monsanto was responsible for his illness and should have known of the products dangers. The jury awarded the 46 year old man $289 Million dollars in damages, an amount the trial judge later reduced to $78.5 Million.
