A dream vacation turned into a nightmare for a Texas couple who were electrocuted in a hot tub at a private resort in Rocky Point, Mexico. Jorge Guillen, 43, lost his life and his wife Lizette Zambrano, 35, was transported to a local hospital with life-threatening injuries. The El Paso, Texas couple were enjoying a relaxing evening in the jacuzzi at the Sonoran Sea Resort when disaster struck. Rocky Point is about a 5-hour drive from Arizona. Officials from the State of Sonora said it’s believed a surge of electricity ran through the hot tub while the couple was using it. This electrical surge led to the fatal electrocution of Jorge and leaving Lizette in critical condition. Eyewitnesses at the scene reported noticing the couple unresponsive in the jacuzzi. A witness at the scene attempted to enter the hot tub to help but was shocked upon contact with the water.
The aftermath was captured in a video that has gone viral on social media. The video shows people gathering around the jacuzzi and onlookers screaming for help as his submerged body floated in the water. The State of Sonora’s attorney general’s office stated investigators were working to “determine the origin of the electrical failure.” Searching for any prior incidents like this at the resort did not yield any evidence that this had happened before at the Rocky Point Resort.
An investigation into the cause of the accident will reveal whether the hotel is liable for negligence and determine what exactly caused the hot tub to malfunction. The resort’s website says the swim areas don’t have a lifeguard on duty and it’s unlikely a lifeguard could have done anything to prevent the accident since the jacuzzi was too dangerous to enter. The resort could potentially face liability if it is determined negligence contributed to the electrocution incident. This negligence could relate to improper maintenance of electrical systems, lack of safety inspections, or failure to address known hazards. This is why a thorough investigation is needed to establish fault.
Should the resort be found liable, it could face lawsuits from the victims’ families seeking damages for wrongful death, medical expenses, and pain and suffering. The resort may also be subject to fines or penalties from Mexican regulatory authorities. Hopefully the resort has insurance to cover accidents and injuries as a business. The extent of coverage and whether it would apply in this case is currently unknown.
Resorts are legally obligated to provide reasonably safe premises and protect guests from foreseeable dangers, including hazards like faulty electrical systems that could cause electrocution. This duty is known as “non-delegable,” which means the resort is responsible even if they hired a contractor. Incidents like these are reminders of the importance of proper safety measures and maintenance at resorts and recreational facilities. As a result of this tragedy, authorities must thoroughly investigate the cause of the electrical surge and determine if the resort’s negligence contributed to the incident. Lizette continues to fight for her life in the hospital.
