A few years ago I met with a lady who had shoulder surgery because she slipped and fell at a grocery store. The insurance company denied the claim saying there was no liability and they were not going to pay any money for the claim. The insurance company said the lady should have been looking where she was going. She had been represented by a “law firm” for almost 2 years. The “law firm” did no investigation and there was very little communication with the lady.
The “law firm” abandoned the lady and dropped her like a hot potato when they realized they couldn’t settle her case and make a quick buck. To make matters worse, if she didn’t file a lawsuit within a month she wouldn’t be able to recover any damages. (Because in California you have 2 years from the date of incident to file a lawsuit like this)
We took the case because the lady said she slipped on a large piece of soggy cardboard. While she was still on the floor she overheard one of the employees say that the machine that watered the vegetables was leaking and that’s why the cardboard was on the floor. We immediately started an investigation, took witness statements and filed a lawsuit. We did a formal inspection of the store, sent lots of written questions and requested documents from the grocery store and took about 10 depositions including witnesses to the fall, the store employees and the manager.
After about 2 years of litigation the case was set for trial. The defense admitted the accident was their fault for the dangerous condition and asked to do a mediation a couple weeks before trial. Fortunately our client was compensated for her injury. It settled for more than a half million dollars. Moral of the story is; MAKE SURE YOUR LAWYER IS TOTALLY COMMITTED TO YOUR CASE!
We represent people who are injured because of the careless and reckless acts of others. At the end of the day your case can only be resolved one time and you need to know all of the facts beforehand. And if the offer from the insurance company does not compensate you, we are more than happy to take the case to trial. The reason that insurance companies have paid our clients in excess of $140,000,000.00 is that we get the facts and are not intimidated at the prospect of going to trial when insurance companies fail to offer full compensation. We help with serious injuries that require serious representation. We are the Law Offices of Guenard & Bozarth, LLP. Our attorneys have more than 60 years of experience specializing in only representing injured people..
