James Dempsey survived a world war, raised his children, buried his wife and knew his best years were behind him. The 89 year old veteran could never imagine a nursing home would lead to his demise. His family was so concerned they hid a camera in his room that James knew about and no one else did.
On February 27, 2014 in front of the camera at 4:34 a.m. James threw his leg over the edge of his bed and started frantically pressed the button for the nurse while saying “Help me, help me, help me”. A few seconds later he was pleading for help again and the only immediate answer was the soft glow of his in room television. A full 8 minutes passed before a worker entered the room and adjusted his bed, inspected some tubes around his neck, turned off the call light and left him alone. That was the last contact with anyone who could have reasonably made a difference and possibly saved his life.
A year later in a deposition the night supervisor who was on duty was shown the video and asked if the patient appears to be gasping for air and further asked if it appeared to be an emergency situation. The nursing supervisor Wanda Nuckles said it did in fact appear that way. The attorney asking the question asked how it made her feel and her response was “Sick”. When staff returned nearly an hour later Mr. Dempsey was found unconscious and nearly another hour passed before 911 was called.
