In June 2014 Comedian Tracy Morgan was a passenger riding with a friend in a bus on the New Jersey turnpike. Morgan had just left a comedy club where he and his friend were performing when the bus they were riding in was hit. The vehicle that hit them was driven by Kevin Roper who was employed by Wal Mart. The lawsuit filed by Morgan’s lawyer alleges negligence on the part of Wal Mart for allowing their driver to operate a big truck without sufficient sleep and for exceeding the speed limit by 20 MPH.
Mr. Morgan started out by fighting for his life after sustaining a broken leg, broken nose and broken ribs. Mr. Morgan is now fighting the effects of a Traumatic Brain Injury or TBI as it is known in medical circles. It is likely that the TBI that he is fighting may be the biggest barrier to recovery and from our first-hand experience with injuries like these it’s very likely that Tracy Morgan may never be the Tracy Morgan he once was.
Injuries like TBI’s require extreme diligence on the part of the plaintiff’s attorney. Traumatic Brain Injuries don’t reveal themselves with canes, crutches or neck braces. TBI’s reveal themselves through testing, knowing what the tests reveal and then associating them with the trauma that was experienced by the patient. The potential for anyone to suffer a TBI is one of the reasons that insurance companies want to settle cases like this as rapidly as possible. They know that once you sign away your rights they are off the hook for the possibility of injuries that are discovered at a later date.
Benedict Morelli is Mr. Morgan’s attorney and he fears that his client will never be the same. Any responsible personal injury attorney knows that it can take a very long time to determine how someone is going to recover and to what extent recovery is even possible. TBI’s effects are a huge unknown and while someone may recover physically they may never fully recover mentally. Mr. Morelli says that the injury is severe and that Mr. Morgan Is working diligently to minimize the long term effects on the injury.
When anyone has been injured and there is even the potential for a TBI it is imperative for either the patient’s doctor or their attorney to slow down and take the required steps to confirm a diagnosis. This takes time and can’t be rushed without devastating consequences. At the Law Office of Guenard & Bozarth we work with Neurologists that specialize in the diagnosis and treatment of Traumatic Brain Injuries. While this does extend the time for settlement it is that time and that level of attention that can mean the difference between a fair settlement that actually compensates someone for their injuries or just gets a few dollars for someone to spend.
